I am directed to acknowledge the receipt of your

letter No.S.B.0.1 in 256/1935 dated 13th May, 1937, forwarding an amendment to the by-laws made under the Public Health (Food) Ordinance, 1935, designed to enforce, after due notice, the pasteurization of all milk sold in the Colony.

2. In view of the fact that this matter is reported

to be at present the subject of special investigation in the United Kingdom, and in view of the further fact that the Dairy

Farm Company, which is the main source of supply in the Colony, is well known to be selling no unpasteurized milk, it has been decided by Government that the Legislative Council should not

be invited to signify its approval of the by-laws in question

until reference has been made to the Colonial Office.

The result of such reference will in due course

be reported to the Urban Council and if its opinion is unchanged

a simple alteration of the date in the draft by-law 1A will be

all that is necessary.

I am to make it clear that action on these lines,

in accordance with the provisions of section 7 of Ordinance 13

of 1935, is not intended to signify any abridgement of the statutory powers of the Urban Council in this important matter; but that exceptional circumstances seem in this case to justify

the retarding action which that section contemplates.
